Featured videos terms

The original of this document is in Spanish. This version is a courtesy translation; in case of discrepancy, the Spanish one prevails. Spanish law applies.

These terms govern the booking of a featured video on viralteca.com, owned by Viralteca SL. By bidding you accept them in full, so it is worth reading them: they are short on purpose.

1. What exactly you are buying

What you are buying is the appearance of a video in the featured space on viralteca.com, in the position that matches what you bid. That space is labelled Bids, is paid for, shows what has been paid for each position and is separate from the editorial ranking that appears below it.

There is a single featured space, the one on the all-time ranking, because there is a single ranking.

Within that space, videos, Shorts and channels each have their own column, with their own running totals and their own prices. You compete within the same column, not against the others: being first among the Shorts does not mean being ahead of the videos.

Any public YouTube video, Short or channel will do, whether or not it is in the rankings. The column is decided by the content itself: a vertical or square video is a Short and goes in its column; a landscape one goes in the videos column; and a channel link — youtube.com/@account or youtube.com/channel/… — goes in the channels column.

The editorial ranking is not for sale. Positions in the rankings are determined solely by the figures YouTube publishes: views or “likes” for videos and Shorts, and subscribers for channels. No amount of money changes that list.

2. How bidding works

  • Every featured video has a running total: the sum of everything that has been paid for it. The running total does not expire: what has been paid keeps counting indefinitely.
  • Featured videos are ordered from the highest running total to the lowest. The highest goes on top.
  • To get above another one you have to beat its running total.
  • If you are overtaken, getting the position back costs only the difference: what you had already put in still counts.
  • The running total is per video, not per person: anyone can bid on a video that is already featured, and whatever they contribute is added to that video’s running total. Switching to another video starts from zero.
  • A video that was not in the featured space enters it as soon as the first bid is paid, in the position its running total earns it.
  • The home page shows the five highest running totals in each column. Video pages also show the ten highest running totals overall, without separating by column. Below that nothing is shown, although the running total still counts towards overtaking someone later on.
  • In the event of a tie, whoever bid first on that video goes ahead.

Positions are updated as soon as payment is confirmed. Amounts paid are not refunded merely because someone overtakes you: that is how the service works and you accept it when you bid.

3. Price and payment

The price of each position is calculated at the moment of bidding from the running totals in that column: it is exactly what it takes to beat the video holding it, minus whatever your video had already put in. Bids are made in whole euros, from €1. If your video is already first in its column, you can add whatever amount you like to pull ahead.

The price is checked again before charging. If someone bids while you are choosing and the position comes to cost something else, nothing is charged and you are shown the new prices. Prices are shown in euros and include any applicable taxes.

Payment is handled by Stripe. Your card details are entered in Stripe’s environment and Viralteca never sees or stores them.

4. Duration

There are no seasons and no resets. A featured video stays in the space for as long as its running total remains one of the highest, with no time limit. It only drops down when another video beats its running total, and it only disappears from the space if enough videos beat it.

This means that what is paid is neither recovered nor used up: it is not a subscription or a rental by the day, it is a position in a list ordered by accumulated money.

5. Content that is not accepted

Videos are not accepted if they:

  • are illegal, or incite hatred, violence or discrimination;
  • are pornographic or sexually explicit;
  • infringe third-party rights, including intellectual property, honour, privacy or image rights;
  • promote drugs, weapons, gambling aimed at minors, scams or misleading financial products;
  • single out, harass or expose a specific person;
  • are broken, private or have been taken down from YouTube.

Viralteca may reject or remove any featured placement that breaches this or that, in its reasonable judgement, harms the service. In that case everything paid for the part not enjoyed is refunded in full, unless the breach is manifestly wilful.

You may only bid on a video if you are its author or have its author’s permission, and you are answerable for that.

6. Right of withdrawal

A featured placement is digital content that is performed immediately: the video is placed in the space as soon as payment is confirmed. Under article 103.m) of the texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios (the Spanish consolidated consumer protection act), by placing the order you expressly request that performance begin immediately and acknowledge that this entails the loss of the fourteen-day right of withdrawal. This acceptance is collected expressly in the form, with a box that is not ticked in advance.

This does not affect your rights if the service is not properly provided: if the featured placement does not appear through our fault, the amount is refunded.

7. Interruptions

If the featured space cannot be shown because of a fault attributable to Viralteca for more than twenty-four hours in a row, you may ask for a refund of the last bid made in the seven days before the fault.

8. Complaints

Any complaint goes to hola@viralteca.com and is answered within a maximum of one month. If you are a consumer, you may take your complaint to the Junta Arbitral de Consumo (the Spanish consumer arbitration board) or to the consumer authority of your autonomous region.

9. Governing law

Spanish law applies. If you are contracting as a consumer, you keep the jurisdiction of your own domicile; in all other cases, the parties submit to the courts of the owner’s domicile.
